Rep. Gill Joins Judiciary Committee Amicus Brief Supporting President Trump’s Executive Order on Birthright Citizenship

WASHINGTON, D.C. – Congressman Brandon Gill (R-TX), along with 17 House Judiciary Committee Republicans, filed an amicus brief in the United States District Court for the Western District of Washington and the United States District Court for the District of Massachusetts in support of President Trump’s Executive Order on Protecting the Meaning and Value of American Citizenship. 

“The Left has misused and abused birthright citizenship for too long,” said Congressman Gill. “President Trump’s executive order must be swiftly enacted. I’m proud to join House Judiciary Committee Chairman Jordan in signing this amicus brief supporting President Trump’s executive order.”

“It would have been easy enough to say ‘subject to the laws’ of the United States, but instead the drafters used a different term: ‘jurisdiction.’ That was intentional,” states the lawmakers’ brief.

The brief goes on to say that “Plaintiffs have no way to explain how individuals who are clearly subject to at least some of the laws of the United States are nonetheless not subject to the laws of the United States. The answer is that Plaintiffs’ test is just the wrong one… The touchstone for birthright citizenship under the Fourteenth Amendment is allegiance to the United States, rather than merely being subject to its laws or some subset thereof.” 

House Judiciary Republicans remain steadfast in their commitment to upholding constitutional integrity and ensuring that U.S. citizenship is reserved for those with rightful allegiance to the nation. The committee will continue to monitor developments in this case as the legal battle over birthright citizenship unfolds.
