Congressman Brandon Gill’s First Bill Codifies Trump’s Border Policy

January 9, 2025

Washington, D.C. — Freshman Congressman Brandon Gill (TX-26) today introduced his first bill of the 119th Congress, the REMAIN in Mexico Act, a bill that codifies one of President Trump’s successful immigration policies.

“President Trump’s Remain in Mexico policy was extremely successful, resulting in fewer illegal border crossings, fewer fraudulent asylum claims, and more deportations,” said Congressman Gill. “But immediately after taking power in 2021, Democrats undid nearly all of President Trump’s border protection policies, unleashing mass chaos and destruction throughout our heartland. Over the past four years, Biden invited over 10 million illegal aliens to invade our country, and Democrats have made it their mission to prioritize criminal illegal aliens over law abiding American citizens. As a result, illegal aliens are murdering, raping, and pillaging American citizens.”

“This must end now," continued Gill. “The American people gave President Trump and Republicans a mandate to secure our border, and Congress must pass the REMAIN in Mexico Act as a first step to secure our border and fix the problems Democrats created in our country.”

President Trump’s “Remain in Mexico” policy is officially known as the migrant protection protocols, first implemented by the Trump administration in January 2019. The protocols allow the U.S. government to return non-Mexican asylum-seekers (who entered the U.S. via the southern border) to Mexico to await immigration proceedings.

Gill’s legislation would require the Secretary of Homeland Security to reinstate the Migrant Protection Protocol in accordance with 2019 Homeland Security documentation titled “Policy Guidance for Implementation of the Migrant Protection Protocols.”

"The Migrant Protection Protocols (MPP), commonly called ‘Remain in Mexico’, was one of the most consequential actions taken by the Trump Administration when it faced a surge of illegal aliens in 2019. As fraudulent asylum seekers realized they would no longer be released into the interior, they simply stopped coming. Unsurprisingly, the Biden Administration’s cancellation of the program led to a historic four-year border surge. The REMAIN in Mexico Act would restore MPP, and the Immigration Accountability Project is thankful to Congressman Gill for introducing it," said Grant Newman, Director of Government Relations, Immigration Accountability Project.

"NumbersUSA applauds Rep. Brandon Gill for prioritizing securing America's Southern Border by making his first bill "The Remain in Mexico Act." This legislation will permanently fix one of the biggest blunders from the Biden/Harris Administration, which overturned President Trump's successful remain in Mexico policy," said Michael Hough, Director of Federal Government Relations.

“The Biden administration’s outrageous open border policies have destroyed our immigration system, abandoned the rule of law, and harmed millions of American citizens. Enough is enough. Republicans campaigned on the promise to secure the border, and in November, the American people gave them a mandate to deliver. The Remain In Mexico Act is an important step to protect American citizens and begin restoring stability to our broken immigration system,” said Ryan Walker, Heritage Action Executive Vice President.

"Reimplementation of the Migrant Protection Protocols, also known as the Remain in Mexico policy should be prioritized by Congress and the Administration. The policy in Representative Gill's legislation is vital to the security of Texas and the nation," said Greg Sindelar, CEO of the Texas Public Policy Foundation.
